These Terms & Conditions (“Terms”) govern your access to and use of coastalwindsco.com(the “Site”) and any related services operated by Coastal Winds Co. (“Coastal Winds,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms.

If you do not agree, please do not use the Site. Nothing in these Terms limits rights that cannot be excluded under applicable consumer protection laws in the United States, Canada, the United Kingdom, or the European Economic Area.

To the extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (USD $100), except where applicable law requires otherwise.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Coastal Winds from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

11. Governing law

These Terms are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-law principles, except where mandatory local consumer protection laws in your country of residence provide otherwise.

United States

If you are located in the United States, any dispute not subject to mandatory arbitration or small claims court jurisdiction may be brought in state or federal courts located in Texas, unless applicable law requires a different venue.

Canada

If you are a consumer in Canada, you benefit from mandatory protections under applicable provincial and federal consumer protection laws. Nothing in these Terms excludes warranties or remedies that cannot be excluded under Canadian law.

United Kingdom and EEA

If you are a consumer in the UK or EEA, you benefit from mandatory consumer rights under applicable local law. Nothing in these Terms limits your statutory rights as a consumer.

12. Dispute resolution

If you are located outside the United States, you may also have the right to use an approved alternative dispute resolution body or court in your country of residence where required by law.

13. Severability
